Terms of Service

Last updated: October 12, 2026

These terms apply to your use of five30am.com and to any SEO audit or site build you buy from Five30AM ("I", "me"). By using the site or paying for a service, you agree to them.

The services

I offer fixed-price SEO audits and niche site builds. What each package includes, what it costs, and how long it takes are described on the services page. The scope and price shown there when you pay are the scope and price that apply to your project.

Payment, refunds, revisions, and delays

The services page sets out how payment works, when refunds are available, how many revision rounds each site build includes, and what happens when client delays push back a delivery date. Those terms, and the founding-client terms where they apply, are part of this agreement. In short, they are:

  • Payment: audits are paid in full upfront, and site builds are split between a deposit and a balance on delivery.
  • Refunds: cancelling before work starts earns a full refund, and later payments follow the rules on the services page.
  • Revisions: builds include one revision round and the Rebuild includes two, as listed on the services page.
  • Client delays: the timeline moves back by the same amount of time as the delay.

If this summary and the services page ever differ, the services page controls. The version of the services page and of these terms in effect on the day you pay is the one that applies to your purchase. Payments are processed by Stripe. See the privacy policy for how that works.

No guarantee of results

Search rankings, traffic, and affiliate program approvals are controlled by third parties such as search engines and affiliate networks. I design my work to improve a site's foundation and usefulness, but I cannot promise any particular ranking, traffic level, or income. Case studies on this site describe my own past results and are not a forecast for yours.

What I need from you

You are responsible for the accuracy of what you give me, for owning or having authority over the domain, hosting, and accounts involved, and for paying third-party costs such as themes, plugins, domains, and hosting. Please share access through the secure sharing tools your providers offer.

Ownership of deliverables

Once you have paid in full, the written reports and other deliverables I make for you are yours to use for your business. Anything you give me stays yours. I keep my general methods, templates, tools, and know-how, and I may use what I learn from a project, in anonymized form that does not identify you or your site, to improve my work and to write about it. I will not publish a case study that identifies you except as described in the founding-client terms.

Confidentiality

Each of us will treat the other's non-public information as confidential. For me, that includes your data, access credentials, and project details. I will use them only for your project and will not share them except with the tools described in the privacy policy. For you, that includes my working methods and any draft materials before delivery. This does not cover information that is already public, that you or I learn from someone else without a duty of confidence, or that the law requires either of us to disclose. Please revoke any access you gave me when the project ends.

Limitation of liability

The services are advice and implementation work, not a guarantee of results. To the extent the law allows, my total liability for any claim relating to a project is limited to the fees you paid for that project, and I am not liable for indirect, incidental, or lost-profit damages. Nothing here limits liability that the law does not allow to be limited.

Business use

The services are for business purposes. They are not sold to consumers for personal, family, or household use.

Founding-client terms

Where they apply, the founding-client terms on the services page are also part of this agreement.

Governing law

These terms are governed by the laws of the State of Tennessee, and any dispute that cannot be resolved informally will be brought in the state or federal courts located in Tennessee. If one part of these terms turns out to be unenforceable, the rest still applies.

Using this site

Please do not misuse the site, try to break it, or send spam through the contact form. The text, logos, and design on five30am.com belong to Five30AM. Links to other sites are provided for convenience and I am not responsible for what those sites do.

Changes

I may update these terms from time to time. The version on this page on the day you pay for a service is the one that applies to that service.
